Section 24G Application for the Rectification of Unlawful Upgrade and Expansion at The Ultra City Three Sisters Service Station in Western Cape, South Africa

A SECTION 24G RECTIFICATION PROCESS IS REQUIRED FOR THE UNLAWFUL COMMENCEMENT OF LISTED ACTIVITIES IN TERMS OF THE ENVIRONMENT CONSERVATION ACT, (ECA), 1989 (ACT NO. 73 OF 1989) AND THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT, (NEMA), 1998 (ACT NO. 107 OF 1998) FOR THE UPGRADE OF ULTRA-CITY THREE SISTERS SERVICE STATION IN BEAUFORT WEST, WESTERN CAPE, SOUTH AFRICA.

LOCATION: FARM 245 PORTION 0 AND PORTION 4

INITIAL SITE OPERATIONS COMMENCED IN 1974 WHICH IS PRIOR TO THE PROMULGATION OF THE ENVIRONMENT CONSERVATION ACT, (ECA), 1989 (NO. 73 OF 1989) AND THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT, (NEMA), 1998 (NO. 107 OF 1998). THE SITE THEREFORE DID NOT REQUIRE AN ENVIRONMENTAL AUTHORISATION AT INCEPTION.

IN 2008, THE SITE UNDERWENT UPGRADES AND EXPANSIONS OF UNDERGROUND FUEL STORAGE INFRASTRUCTURE WHICH WOULD REQUIRE AN APPLICATION FOR ENVIRONMENTAL AUTHORISATION IN TERMS OF ACTIVITY 3 OF THE NEMA ENVIRONMENTAL IMPACT ASSESSMENT REGULATIONS, 2006 (GN R 387 OF 2006), THAT STATED:

“ACTIVITY 3: THE CONSTRUCTION OF FILLING STATIONS, INCLUDING ASSOCIATED STRUCTURES AND INFRASTRUCTURE, OR ANY OTHER FACILITY FOR THE UNDERGROUND STORAGE OF A DANGEROUS GOOD, INCLUDING PETROL, DIESEL, LIQUID PETROLEUM GAS OR PARAFFIN.”

Status

Notice is hereby given, in terms of the National Environmental Management Act (No. 107 of 1998; NEMA) and the Environmental Impact Assessment (EIA) Regulations, 2014 (as amended), that the draft Section 24G Report prepared for the aforementioned project has been made available for a 30-day public and authority review and comment period from 15 November 2021 to 14 December 2021.
