An introduction to The Environment Act and Biodiversity Net Gain - in association with the Tank Storage Association

After 21 months of Parliamentary process, the UK’s Environment Act 2021 gained Royal Assent (agreement) on 9 November and has now been published. The Act is arguably the most significant piece of UK environmental legislation since the introduction of Environmental Impact Assessment (EIA) back in 1988, and it’s also fairly unique as it makes specific provision for review and revision of requirements. This means we can expect consideration of progressively stringent requirements over time. 

The main focus of the Act is the “…provision for targets, plans and policies for improving the natural environment…” and its requirements are structured around a number of broad themes, including one related to nature and biodiversity. 

Amongst other provisions, the Act importantly includes for “biodiversity gain in planning” which will apply to applications under the Town & Countryside Act and the Planning Act. 
This session will provide you with an understanding of the Environment Act and help you to understand what it might mean to you in terms of biodiversity.

With over 25 years of environmental experience as a consultant and public servant, Stuart has 18.5 years as an environmental advisor (at various levels) looking after the Strategic Road Network. Most recently with National Highway’s (and its predecessor organisations) Stuart is an expert technical advisor for infrastructure projects in England, Wales, Scotland and Northern Ireland including on environmental impact assessment (EIA), Habitats Regulations Assessment (HRA) and, biodiversity assessments. He has provided expert environmental advice to Government on the development of legislation including various EIA statutory instruments and most recently on aspects of the Environment Bill.
