Challenge
The Denver Metro/North Front Range (DMNFR) was reclassified to Severe Nonattainment status for ozone precursors in 2022. This started a one-year hard deadline to file Title V paperwork or to re-permit facilities near the Major source threshold under this new designation, a large lift for most companies to achieve.
The redesignation for Severe Nonattainment for the 2008 Ozone standard for the DMNFR meant any stationary source with potential to emit (PTE) of VOC or NOx exceeding 25 tpy would be classified as a Major Source under the Title V program. This required the filing of paperwork for time-consuming and costly Title V permits and/or re-permitting and optimizing facility processes to bring PTE under Major Source thresholds within one year of redesignation.
The reclassification affected dozens, if not hundreds, of facilities for upstream O&G operators in the area, with a tight window to meet requirements, overcoming significant hurdles.
Our client, a major energy operator within Colorado, was one of the businesses impacted by this change and sought SLR’s support in ensuring compliance within the one-year timeframe.
Solution
SLR has managed the permitting program for operators in the Denver-Julesburg (DJ) Basin for many years and has expertise in both Colorado and Federal permit programs affecting operators in the area.
Leveraging our expertise in process, emissions evaluations, and requirements under Colorado regulations, SLR began supporting over 70 permit actions to meet the needs of our client and the DMNFR reclassification. SLR staff then filed the appropriate paperwork for every site to ensure the deadline was met within the 1-year timeframe.
Impact
Our client successfully met regulation standards on time and continues to retain SLR’s support in permitting needs.
Since the kickoff of this project in 2022, the client has not had any compliance-related issues with the timing and filing of our permit applications stemming from reclassification, alleviating the client’s concern at the outset of this project.
